THE TENANT
The Tenant undertakes to use the rented property as a responsible occupant, in the legal sense of the term.
The Tenant shall refrain from doing anything that could disturb the peace of the neighbourhood surrounding the property, and shall not carry out any works, alterations, demolition, or openings in the walls or partitions of the rented property, nor make any other changes, without the express written consent of the owner.
BOOKING
The rental between the Tenant and the owner is conducted online through the website. The rental price for a stay is listed on the website, based on the rental period, at a per-night rate.
Upon booking and payment of the 30% deposit — or the full amount if the stay begins within 30 days — the Tenant receives the rental agreement showing the deposit paid and the outstanding balance, as well as a payment confirmation email with a summary of the rental including the villa, dates, and amount.
Upon payment of the balance, the welcome contact details and directions to the villa with its address are sent.
The Tenant must verify that the booking details are accurate and complete, and report any errors or omissions to the owner.
The Tenant may pay online by credit card at the time of booking, by bank transfer, holiday vouchers, or bank cheque. The booking only becomes final upon receipt of the deposit payment and the confirmation email (in the meantime, the seasonal rental is considered an option). The rental can only proceed upon receipt of the full balance at least 25 days before the start of the rental period. If payment is not received by this deadline, the booking shall be considered null and void and the dates will be made available again. For “last-minute” bookings made less than 30 days before the arrival date, full payment of the entire rental amount will be required. In the event of non-payment, all procedural and enforcement costs incurred, as well as bailiff fees, shall be borne by the Tenant.
PROPERTY INSPECTION
A property inspection will be carried out by the owner or the person in charge of the welcome upon arrival at the villa and on the day of departure.
PRICES
All prices quoted are per night.
Bed linen is included in all villas.
Our prices are all-inclusive, fees and taxes included.
RENTAL PERIODS // CHECK-IN AND CHECK-OUT
Rental periods are flexible. Check-in time: from 2:00 PM. Check-out time: before 12:00 PM.
The rental may not be extended without the owner’s consent, which the Tenant hereby accepts. The Tenant declares on their honour that they do not practise and do not seek to practise any profession on the premises, and that the property is rented solely as a temporary residence — a fundamental condition without which the rental would not be granted.
The Tenant is requested to telephone the reception service no later than the day of arrival to arrange a meeting time and must notify of any delay en route. Furthermore, before the arrival date, the guest may request to arrive outside this time window or even on a different day; it shall be at the discretion of the reception host to accept or decline. In cases where the reception host cannot be available after 8:00 PM, they will arrange a meeting with the guests the following morning. The Tenant may access the property independently by retrieving the keys from the secure key box, the code for which will be emailed the day before. In the event of early departure, the Tenant is required to contact the reception host immediately to carry out the property inspection. If the Tenant is unable to be present, they may be represented by a duly authorised person. Failing this, the property shall be presumed to be in the condition in which the reception host finds it. The Tenant may be liable for all damages identified in the check-out inspection.
THE TENANT’S STAY
The Tenant acknowledges that the seasonal rental is concluded as a temporary and leisure residence. The premises may not be used as a primary or even secondary residence, and the Tenant may not carry out any commercial, artisanal, or professional activity therein. Under no circumstances may the property be occupied by a greater number of persons than that stated in the villa description on the website. The number of persons (adults, children, infants) is specified in the booking contract and may not be changed except upon request authorised by the owner.
The Tenant undertakes to respect the rented property and its surroundings, the peace of the neighbourhood including noise levels, and to use the holiday home in accordance with the reception host’s instructions.
The Tenant undertakes to accept the rented premises in the condition they are found at the start of the tenancy, as described in the property description provided on the website. The furniture and movable items shall only suffer depreciation resulting from normal use for which they are intended. Any items that are missing or rendered unusable at the end of the rental, for reasons other than normal wear and tear, must be paid for or replaced by the Tenant. This clause also applies to the villa in general (interior and exterior).
The Tenant is required to use the furniture and items in the rented property for their intended purpose and in the locations where they are found. The Tenant is strictly prohibited from removing them from the rented premises.
The Tenant must absolutely refrain from throwing into sinks, baths, bidets, kitchen sinks, washbasins, toilets, etc., any objects likely to block the plumbing. Failure to do so will make the Tenant liable for the costs of restoring these installations.
The Tenant may under no circumstances sublet the property, even free of charge. The Tenant must occupy the premises and may not, under any pretext, store furniture therein, with the exception of personal clothing and small items.
The Tenant must allow urgent works necessary for the maintenance of the rented premises and common equipment to be carried out on the property.
Upon departure, the Tenant undertakes to leave the house tidy and in a good state of cleanliness. All items present in the house must be returned to where they were upon arrival. Dishes must be washed and put away, and waste must be placed in the location designated by the reception host. The reception host reserves the right to inspect the property at the end of the stay. Cleaning costs are included in the rental price.
The Tenant may be charged for the value of any chipped or broken items, and the cost of laundering or cleaning any carpets, blankets, mattresses, bedding, etc. that have been stained.
The Tenant shall be liable for any damage or loss caused by their own actions or those of any occupant under their responsibility, unless they can prove that such damage was caused by a third party or an unforeseeable event beyond the Tenant’s control.
CLEANLINESS OF THE PROPERTIES
The properties must be left reasonably clean upon departure and kept in a normal state of cleanliness during your stay. A final cleaning is provided by the owner; however, if the villa is returned in an excessively dirty condition, an additional charge may apply. Upon arrival, you may also note the state of cleanliness in the check-in inspection report.
VISITING THE PROPERTY BEFORE BOOKING
It is possible to visit the villas beforehand, subject to the owner’s approval of your visit.
PROPERTY DESCRIPTIONS
All our villas are inspected regularly. The descriptions are fully and faithfully summarised on our website. If, despite these precautions, your rental does not fully correspond to the description provided, or if a listed amenity is missing, the owner cannot be held responsible for any fault (due to concealment, omission, hidden defect, etc.) regarding the villa or its surroundings. Any shortfall in the stated services may be subject to financial compensation and an appropriate refund.
GUEST CAPACITY
If you exceed the number of persons specified in your booking, you must inform us. However, you may not exceed the maximum capacity of the villa as indicated on the villa page. Upon request, a folding bed may be added. This applies upon arrival or throughout the duration of your stay. You may be refused entry or charged a surcharge rightfully claimed by the owner.
PETS
Pets are accepted in the vast majority of cases. Please make a request when booking using the comments field available during the reservation process. You will also be asked for details about your pet. If prior acceptance has not been obtained, the local representative or the owner may refuse the pet’s presence. The Tenant is responsible for their pet and for any damage or accident it may cause. Dogs must remain outside the house.
SWIMMING POOL
Please note that supervising children is mandatory, and parents may be held liable regardless of the existence of safety equipment. Similarly, adults who are not confident swimmers must always remain under the supervision of a person capable of assisting them.
All villas with a pool offered for rent have a private pool for the exclusive use of the tenants.
Pools may be indoor, but it is important to note that pool heating outside the summer period is subject to weather conditions and ambient temperature. For stays outside summer, pool heating is not guaranteed, and the Tenant should enquire before booking whether heating is likely to be available for their chosen dates.
SECURITY DEPOSIT
No security deposit is required.
CANCELLATION
1/ Insurance
Any cancellation must be made using the cancellation link provided in the booking confirmation email.
2/ Cancellation penalties
The deposit is refundable without justification up to 30 days before the rental.
Beyond that period, amounts paid are refundable in proportion to the re-letting of the villa for the same dates.
EXCEPTIONAL UNAVAILABILITY OF THE RENTED PROPERTY
In the event of exceptional unavailability of the rented property for reasons beyond the owner’s control, such as force majeure, fire, flood, or unforeseen circumstances such as the sale of the property, illness of the owner preventing them from providing the welcome, bereavement, or works affecting the rental and its immediate surroundings that significantly impact the rental, the owner will endeavour to offer the Tenant an alternative property of equal or superior standard and equal or greater capacity. In such cases, the Tenant shall not be entitled to any refund or compensation.
If the Tenant does not accept the alternatives proposed by the owner, or if no alternative of equal standard and capacity is available, the owner undertakes to refund the full amount of the stay to the guest. The guest shall not be entitled to any additional compensation.
In the event of force majeure affecting the island or part of the island of Djerba, such as an oil spill or other natural or man-made disaster, rentals may be cancelled. Deposits and outstanding balances already paid by their due date shall be refunded.
COMPLAINTS
If you wish to make a complaint about the essential qualities of your rental, you must notify us by telephone within 48 hours of your arrival. To be considered, this complaint must be followed by an email to [email protected]. After this period, no complaint will be considered. We will then send you a possible compensation proposal.
BOOKING CONDITIONS
If the Tenant’s stay begins more than 30 days after the booking, a deposit of 30% of the rental amount is required at the time of booking. Otherwise, the full amount is due at the time of booking.
When only a deposit has been paid, the balance is due 30 days before the start of the rental, and the Tenant has 5 days to settle it. A reminder will be sent by email and, if necessary, by telephone.
If we do not receive the balance within the aforementioned deadlines, your booking may be cancelled automatically, with the amounts due remaining payable to the owner.
LIABILITY
The owner cannot be held liable for any inconvenience suffered by the Tenant caused by third parties.
The owner’s liability shall not be engaged in the event of temporary water and/or energy supply interruptions, heating system failures, pool issues, etc., nor in the event of changes to road layouts, access routes, or the relocation/closure of shops or businesses.
Should the owner’s liability be engaged, it shall be limited to direct damages, excluding all indirect damages. In such cases, the owner’s liability shall be limited to the amount of the rental.
TERMINATION OF THE RENTAL AGREEMENT
The owner may terminate the rental agreement without compensation in the following cases:
a) After a formal notice sent by email has remained unanswered for 48 hours, and the Tenant has not met their obligations under these terms, the rental agreement, or the house rules;
b) The Tenant does not respect the rented property and its surroundings, including noise disturbance, during their stay, even after warnings from the reception host.
The owner may demand the immediate termination of this agreement, and the Tenant must vacate the premises upon simple request.
The agreement may also be terminated in the event of force majeure, such as natural disasters, oil spills, ecological disasters, nuclear catastrophes, fire, epidemics, war, terrorist attacks, or total destruction of the property.
PERSONAL DATA PROTECTION
The Tenant has the right to object, access, and rectify their data by contacting the owner by email via the contact page on the website.
INTUITU PERSONAE CONTRACTS
Neither party may transfer their rights and obligations to third parties.
SEVERABILITY OF CLAUSES
Should any provisions of the rental agreement and these terms of sale be found to be void, the remaining provisions shall remain in force.
CONSUMER DISPUTE MEDIATION
The owner undertakes to seek an amicable solution in the event of a dispute.
APPLICABLE LAW
These general terms and conditions are governed by Tunisian law. Any dispute arising from these general terms and conditions shall be subject to the jurisdiction of the Tunisian courts.
